Customer Garment Waiver
Customer-Supplied Garment Risk Agreement
Decoration on customer-supplied garments is performed at the customer's risk.
1. Customer-Supplied Garments
Garments not purchased through The Printing Company may vary in fabric composition, dye, construction, coatings, and manufacturing quality. Because these factors are outside of our control, The Printing Company does not guarantee decoration results on customer-supplied garments.
2. Assumption of Risk
The customer understands and accepts that decorating customer-supplied garments involves inherent production risks including, but not limited to: dye migration, scorching, shrinkage, marks from heat or pressure, pretreatment reactions, misprints, embroidery hoop marks, or other production-related imperfections.
By providing garments for decoration, the customer assumes all risk related to the condition, performance, and suitability of those garments during the decoration process.
3. Limitation of Liability
The Printing Company shall not be responsible for damage, spoilage, or loss of customer-supplied garments during production.
If a decoration error occurs, The Printing Company's maximum liability is limited solely to the cost of the decoration service performed on the affected item(s).
The Printing Company will not replace, reimburse, or compensate for the value of customer-supplied garments under any circumstances.
4. Spoilage Allowance
Customers are strongly encouraged to provide 2–5% additional garments to account for potential spoilage during production.
Industry-standard spoilage rates may occur during printing or embroidery, especially on customer-supplied garments.
5. Handling Fee
Customer-supplied garments require additional inspection, handling, and production setup. A Customer-Supplied Garment Handling Fee applies to all outside garments.
6. High-Value Garments
Garments valued at over $100 per item may be declined or may require additional handling fees due to increased financial risk.
7. Trademark & Branding Responsibility
Customers are solely responsible for ensuring they have the legal right to customize garments containing brand names, logos, trademarks, or copyrighted material. The Printing Company assumes no responsibility for trademark or licensing violations related to customer-supplied garments.
8. Chargeback & Payment Agreement
By approving the order and submitting garments for decoration, the customer confirms that they understand and accept the risks associated with decorating customer-supplied garments.
The customer agrees that decoration services performed in accordance with this agreement constitute fulfillment of the order and will not be disputed, reversed, or charged back through any payment provider based on garment damage, spoilage, or decoration outcome on customer-supplied items.
9. Acceptance of Terms
Submission of garments, approval of artwork, payment of invoice, or signing this document constitutes full acceptance of this agreement and all terms stated herein.
